Who is responsible for your information
This is Muhammad Shoaib's personal professional website and is operated by Muhammad Shoaib.
Muhammad Shoaib is the data controller for personal information collected through this website. If a regulated law firm later accepts your instructions, that firm will be responsible for the information it uses to provide legal services and its own privacy information will also apply.
For privacy questions or requests, email shoaib@britonsolicitors.co.uk or write to Muhammad Shoaib at Briton Solicitors, 18 Ravenings Parade, Goodmayes Road, Ilford, IG3 9NR.
Information we collect
Depending on how you use the website, I may handle:
- Booking details, including your chosen legal service, appointment date and time, full name, email address and telephone number.
- Direct communications, including information you provide through the contact form, by email, telephone or WhatsApp and any follow-up needed to deal with your enquiry.
- Technical informationneeded to deliver and protect the website, such as an IP address, browser type, requested page, date and time. The exact information depends on the hosting and security providers in use.
- Reviews and feedbackthat you provide for publication or have made public on a review service. You may ask for a published review to be corrected or removed.
Please provide only the information needed to arrange an appointment or make an initial enquiry. Do not send original documents or detailed confidential material until a regulated law firm confirms how it should be supplied.
How and why we use information
I use personal information only where UK data protection law permits it:
- To answer an enquiry, check availability and arrange a consultation. This is usually necessary to take steps at your request before entering into a contract.
- To administer appointments, keep appropriate business records, prevent misuse and maintain the security of the website. I rely on legitimate interests in running a secure and effective professional website, where those interests do not override your rights.
- To meet legal and regulatory duties, including professional, court, tax, anti-money-laundering and record-keeping obligations where they apply.
- To establish, exercise or defend legal claims and to obtain professional advice where necessary.
- To display the office location through an embedded Google map. I rely on legitimate interests in helping visitors find the office, where those interests do not override your rights.
I do not sell personal information, use booking details for unrelated advertising, or make decisions about you solely by automated means.
Sensitive and criminal-offence information
A legal enquiry can reveal sensitive information, such as health details, racial or ethnic origin, religious beliefs, sexual orientation, or information about allegations and convictions. I ask you not to provide this at the booking stage unless it is necessary.
If this information is needed to assess or handle a legal matter, it is used only with an additional condition permitted by law. This will commonly be because it is necessary for legal advice or for the establishment, exercise or defence of legal claims, or because another specific legal or regulatory duty applies.
International transfers
Cal.com states that booking information is processed in the United States. Resend and its subprocessors, Google, WhatsApp and some technology suppliers may also process information outside the United Kingdom. Where UK personal information is transferred to a country without UK adequacy regulations, an appropriate safeguard required by UK law must be used, such as the UK International Data Transfer Agreement or the UK Addendum to approved standard contractual clauses.
You may contact us to ask for further information about the safeguard used for a particular transfer. You can also read the Cal.com privacy policy, the Resend privacy policy and the Google privacy policy.
How long we keep information
I use the following criteria rather than keeping information indefinitely:
- Booking and preliminary enquiry records are kept for as long as needed to arrange and follow up the appointment, determine whether the firm can act, deal with complaints or claims, and meet legal or regulatory duties.
- This website does not maintain a separate booking database. Cal.com holds the booking record for the account, and records should be removed when they are no longer needed for the purposes above.
- This website does not maintain a separate contact-form database. Resend delivers contact-form enquiries to the configured inbox, where they are kept only as long as needed to respond and meet the purposes above.
- If a regulated firm accepts instructions, the matter file is retained under that firm's client-file retention policy, which will be explained separately.
- Security records are kept only for the period reasonably needed to protect the website, investigate incidents and meet legal obligations.
I may keep a limited record for longer where this is necessary to establish, exercise or defend legal claims or where the law requires it.
Security and professional confidentiality
Appropriate technical and organisational measures are used to protect personal information against accidental loss, unauthorised access, alteration and disclosure. Access is limited to people who need the information for their work. No internet or email system can be guaranteed to be completely secure.
If information becomes part of a prospective or current client relationship with a regulated law firm, it is also handled in accordance with the professional duties of confidentiality that apply to solicitors and regulated firms, subject to disclosures permitted or required by law.
Your data protection rights
Depending on the circumstances, you may have the right to request access to your information, correction, deletion, restriction, portability, or to withdraw consent where consent is the basis used. These rights are not absolute, and a lawful exemption may apply.
Your right to object
You may object to processing based on legitimate interests. You also have an absolute right to object to direct marketing. I do not currently use information collected through this website for direct marketing.
To exercise a right, email shoaib@britonsolicitors.co.uk. I may need reasonable proof of identity and will respond within the time required by law.
Privacy questions and complaints
Please send a data protection complaint to shoaib@britonsolicitors.co.uk. I will acknowledge it within 30 days, investigate it without undue delay, keep you informed where appropriate, and explain the outcome.
You may also complain to the Information Commissioner's Office. Visit the ICO complaints page or call 0303 123 1113. I would appreciate the opportunity to address your concern first, but you do not have to contact us before approaching the ICO.
Changes to this policy
This policy will be updated when the website's services, suppliers or data practices change, or when the law requires it. The date at the top shows when it was last revised. Material changes will be brought to your attention where appropriate.
